Landlord Duties for Rental Water Damage in Hollywood

A burst supply line or a slow leak from an upstairs unit puts a Hollywood renter in an odd spot fast: the water is real, the ceiling is stained, and nobody has said who fixes it or by when. Florida law does answer part of that question, though not with a countdown clock most tenants expect.

What the landlord must maintain

Florida Statute 83.51, part of the Residential Landlord and Tenant Act, tells landlords what they must maintain where no local building or health code already covers it: the roof, exterior walls, foundation, floors, and the plumbing, which the statute says must stay in reasonable working condition.

Why there is no fixed deadline

Reasonable working condition is the actual standard, and it is deliberately not a fixed number of days. A landlord in Hollywood Lakes or Emerald Hills who ignores a plumbing failure for weeks is not meeting it; one who schedules a repair promptly after being told probably is.

What habitability actually covers

Habitability under this statute is about the structure and its systems staying functional, not about the unit looking undamaged. A soaked ceiling or a backed-up drain line under a Driftwood or Liberia rental can make a unit unlivable even while the lease stays technically in force.

Notice starts the clock, not the leak

Notice matters more than most tenants assume. The landlord's duty under 83.51 generally runs from when they know, or reasonably should know, about the problem. A leak nobody reported to the landlord is a very different case than one reported and left alone.

How condo buildings differ

Condominium buildings add a second layer. Florida Statute 718.113(1) makes the association responsible for maintaining common elements, which usually includes plumbing serving more than one unit or running through shared walls, floors, or ceilings between units.

Why the declaration still governs

That statute is a default, not a guarantee. The declaration of condominium for that specific building can assign responsibilities differently, so a tenant in a Hollywood Hills condo needs to check that document, not assume the association covers everything.

Why older plumbing fails this way

Older buildings near Downtown Hollywood or south toward Emerald Hills often still run cast iron drain lines under the slab, plumbed decades ago. Those lines corrode from the inside, and a slow drain or a backup can be the plumbing failing rather than tenant misuse.

Why floors can hide the damage

Chapter 83 puts the repair duty on the landlord: §83.51 requires keeping plumbing in working order and the structure, roof, and floors sound, in Hollywood rentals same as anywhere else in Florida. It doesn't hand a tenant a countdown clock. Habitability turns on whether the unit is livable, not on a fixed number of days, so a slow response can still violate the statute if the damage keeps the unit unsafe.

A common source landlords miss

An overflowing or clogged AC condensate line is one of the more common indoor water sources in a rental here, since cooling systems run most of the year. It leaks quietly into a closet or attic air handler space rather than announcing itself all at once.

The duty does not depend on cause

None of this changes who has to act. A landlord's duty to maintain plumbing in reasonable working condition applies whether the source was a supply line, a drain line, or a condensate pan, and whether the building sits near Young Circle or further out toward Boulevard Heights.

What this means in practice

None of this is legal advice, and disputes over timing or responsibility can turn on facts specific to a lease or a declaration. What matters practically for a Hollywood renter is documenting the leak, notifying the landlord in writing, and getting water addressed before it sits.

Dealing with this in your home?

A ceiling stain days after a storm rarely marks the spot where water got in. On flat-roofed homes near Hollywood Hills or Emerald Hills, water travels along framing before it drops, so the wet insulation and drywall can sit yards from the actual break in the membrane or a clogged drain.
